Agreeing to these terms
By using the site, browsing our products, or placing an order, you’re agreeing to these terms. If there’s something here you’re not comfortable with, the honest answer is that you shouldn’t use the site or buy from us.
We may update these terms from time to time, and the version that applies to your order is the one live on the site when you place it.
Orders and when we accept them
When you place an order, that’s you making us an offer to buy. It doesn’t become a binding sale straight away. We accept your order when we send you an email confirming the item has shipped, and that’s the point the contract between us is formed. An order confirmation on its own isn’t the same as acceptance.
We can cancel or refuse an order, even after you’ve placed it, and we’ll refund you in full if we do. A few reasons that might happen:
- The item is out of stock or we can’t source it.
- There’s an obvious pricing or description error, like a product listed at a fraction of its real price because of a typo or a glitch.
- We suspect the order is fraudulent or the payment doesn’t clear properly.
- We can’t ship to your location.
If we cancel an order you’ve already paid for, you get your money back. We’re not going to keep your payment for something we didn’t send.
Prices
Prices are shown in US dollars (USD) unless the site clearly states otherwise.
We do our best to keep prices accurate, but we can change them at any time. The price that counts is the one shown at checkout when you place your order. If we spot a genuine pricing error after you’ve ordered, see the section above, we’ll contact you rather than just quietly charging you the wrong amount.
Depending on where you are, your order may run into import duties, customs charges, or local taxes when it arrives. Those are your responsibility, not ours, and we’ve no way of knowing or controlling what your country charges. Worth checking before you order if you’re outside our usual shipping regions.
Payment
Payment is taken through a licensed third-party payment processor. Your card and payment details are handled on their systems, not ours. How we treat your data more broadly is covered in our Privacy Policy.
Our content and branding
The Ortario name, our logo, the look of the site, the text, and the product photography all belong to us or are used by us with permission. It took work to put together and it’s ours.
You can browse it and share normal links to our pages. You can’t copy our product images, lift our text, or reuse our branding for your own store or listings without asking us first and getting a yes.
Using the site properly
Use the site to shop, and that’s about it. A few things that aren’t allowed:
- Scraping, crawling, or bulk-harvesting data or images from the site.
- Placing orders you don’t intend to pay for, or using stolen or fraudulent payment details.
- Buying our products to resell them commercially without our authorization.
- Trying to break, overload, or interfere with the site or its security.
- Using the site for anything illegal.
If you’re doing any of that, we can suspend or block your access without much ceremony.
Products
We sell educational toys, books, and kids' clothing, and we try to describe and photograph them accurately. Colours can look slightly different on your screen, and manufacturers sometimes tweak specs or packaging. Small variations like that aren’t a fault.
If something you receive is actually defective or not what you ordered, that’s what the Return & Refund Policy is for.
Returns, refunds, and shipping
These are covered in separate documents so this page doesn’t turn into an essay:
- Our Return & Refund Policy explains how to send something back and how refunds work.
- Our Shipping Policy covers delivery times, costs, and where we ship.
Both apply to your order alongside these terms, so it’s worth reading them too.
Limitation of liability
We stand behind what we sell and we’ll fix genuine problems. That said, there are limits to what we can be on the hook for.
To the extent the law allows, we’re not liable for indirect or knock-on losses, like lost profits, lost time, or costs that pile up beyond the order itself. Where we are liable for something that goes wrong with your purchase, our liability is capped at the amount you paid for the order in question.
None of this takes away rights you have under the law that can’t be signed away. If your local consumer law gives you protections we can’t exclude, those still stand.
Governing law and disputes
These terms are governed by the laws of Hong Kong, and any dispute that can’t be sorted out between us falls under the jurisdiction of the Hong Kong courts.
Before it ever gets that far, please just email us at [email protected]. Most problems are a misunderstanding or a mistake we can fix quickly, and we’d rather sort it out with you directly than have anyone involve lawyers.
Changes to these terms
We can update these terms when we need to. If we make a change that genuinely affects your rights or how orders work, we’ll update the date at the top and, where it matters, flag it on the site. Carrying on using the site after a change means you’re okay with the updated version.
